New FTC Rule and Legislation Target Price Transparency "A new Federal Trade Commission rule requiring transparent prices for hotels, online booking sites, and short-term rentals takes effect May 12, and Congress is moving to make portions of the rule permanent. The House passed the Hotel Fees Transparency Act on April 28 and the Senate companion bill (S. 314) advanced out of the Senate Commerce Committee in February. The legislation and the FTC rule would require online bookers and hotels to include a total price upfront that includes charges or fees for mandatory goods or services, excluding taxes." Will you be held liable for third-party violence on your property? ‘Foreseeability’ is key "If your facility is in an area with known crime and you haven’t taken defensive steps, you could be liable if it’s the site of third-party violence, an attorney says. “On its face I shouldn’t be liable for the violent act of a third party, because I’m not involved in that,” Pernell Choren, an attorney with Wilson Elser, told Facilities Dive. “I don’t control the shooter. Retrial undoes $25M jury award to hotel worker who alleged gender pay bias "The sequence of events in Lindsley played out over nearly eight years of litigation, including multiple appeals and a pair of jury verdicts that appeared contradictory. The jury first held in 2023 that Omni violated neither Title VII of the Civil Rights Act nor the Equal Pay Act, but it nevertheless awarded the plaintiff $100,000 in damages for “past pain and suffering, inconvenience, mental anguish and lost enjoyment of life” as well as $25 million in punitive damages. It did not award any back pay to the plaintiff. The verdict drew confusion from parties to the suit, including the presiding judge, according to a transcript of proceedings. The judge blamed himself for unclear instructions and ordered the jury back for further deliberations under a revised set of jury instructions."
